The crime of genocide is an old one, but the term did not appear until the 1940s.

Genocide has come to mean acts committed with the intent to destroy, in whole or part, a national, ethnic, racial, or religious group.

There are three important elements to the legal definition of Genocide:

1. The acts have to be premeditated, deliberate, and intentional

2. The crime of genocide still applies if the aggressor fails to destroy the entire group

3. The victims are targeted by their nationality, and/or ethnic, racial, or religious group to which they belong

It is South Africa’s claim that Israel’s three-month military assault of the people of Gaza fulfills all three of these elements: deliberate acts with the intention of at least partially destroying a group, targeted in this case because of its ethnicity, race, religion, and nationality.

The purpose of this book is to provide you with the three key documents related to the claim by the Republic of South Africa against the state of Israel in the International Court of Justice (World Court). South Africa is applying to the court for a Provisional Declaration of Intervention.

In layman’s terms, South Africa is asking the World Court to issue an immediate restraining order, specifically the immediate cessation of Israeli military assaults on the people and land of Gaza and the ending of the blockade of food, water, medical supplies, fuel, and other necessities for the maintenance of life.

The three documents are, in the order they are presented in this book:

  • Application Instituting Proceedings and Request for the Indication of Provisional Measures
  • Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention)
  • Genocide Convention Implementation Act of 1987


The first document is the complete text with footnotes of South Africa’s legal action against Israel regarding Gaza in the World Court.

The second document is the complete text of the Genocide Convention that 153 countries are signatories to including Israel, the United States, the UK, and Germany.

The third document is U.S. legislation that relates to the support of the Genocide Convention. It details the responsibility of the United States to uphold this convention and the powers and measures it can use to do so.
